Photo Packs

Please read these Terms of Service ("Terms") carefully before using Photo Packs (the "App") operated by Uptempo Enterprises LLC ("we," "us," or "our").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Photo Packs is an iOS and iPadOS application that helps you create client-ready photo galleries on your device. The App allows you to:

• Import photos from your Photo Library or Files
• Create packs and apply presets (resize, filename templates, watermarks)
• Export to Files, as ZIP, or as PDF contact sheets (Pro)

The App works locally on your device. No account or cloud service is required for basic use.

3. Eligibility

You must be at least 13 years old to use the App, or have your parent or guardian's permission. By using the App, you represent that you meet these requirements and that you will use the App in compliance with applicable laws.

4. Your Content and Conduct

You retain ownership of your photos and any content you create or export using the App. You are solely responsible for ensuring you have the right to use, process, and export that content. You agree not to use the App to:

• Violate any applicable laws or third-party rights
• Infringe intellectual property or privacy rights of others
• Process or distribute content that is illegal, harmful, or offensive
• Reverse engineer, decompile, or attempt to extract the App's source code (except as permitted by law)

5. Pro Purchase

Some features, including unlimited images per pack, custom filename templates, custom watermarks, ZIP export, and PDF contact sheets, require the one-time Pro purchase. There is no subscription or automatic renewal. The purchase is processed by Apple via the App Store. Payment and refund terms are governed by Apple's Terms and Conditions and your Apple ID settings. We do not store your payment information.

6. Intellectual Property

The App and its design, features, and branding are owned by Uptempo Enterprises and protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for your personal or professional use in accordance with these Terms.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPTEMPO ENTERPRISES AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR $50, WHICHEVER IS GREATER.

9. Changes to the App and Terms

We may update the App or these Terms from time to time. We will post updated Terms on this page and update the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the new Terms. If you do not agree, you must stop using the App.
